Terms and Conditions

Atmosferik Photography offer both commissioned and stock 'royalty free' images, subject to the terms and conditions detailed below. Our fees cover multiple uses for in-house purposes only. Atmosferik Photography is and will remain the copyright holder of all our images. It is strictly prohibited to use any of our images for purposes other than for in-house use or to contravene any of the restrictions detailed in our terms and conditions. If any Client is unsure if a particular use of an image is permitted, please just contact us for clarification.

By using this site and purchasing images, you agree to be bound by this Agreement. If you do not accept this Agreement, do not request any images.

In this Agreement:

(a) 'Image' includes all digital images and any related textual information, including captions and credits.

(b) 'Reproduction' includes any form of publication or copying of the whole or part of any image and whether or not altered whether by printing, photography, slide projection (whether or not to an audience) xerography, layout or presentation, electronic or mechanical reproduction or storage by any other means.

(c) 'The Supplier' means Atmosferik Photography.

(d) 'The Client' includes any person or organisation requesting images from the Supplier.

1 The terms and conditions set out herein shall not be varied without the written agreement of the Supplier.

2 The Supplier grants to the Client a non-exclusive non-transferable licence to use the images in accordance with this Agreement.

3 The Client is permitted to use an image more than once for in-house use only. If the Client wishes to use the image again for external use such as magazines or illustration purposes, further permission must be obtained in writing from the Supplier.

4 The Client shall not unless expressly agreed with the Supplier, make any alterations additions or modifications to an image.

5 The Client shall not under any circumstances re-sell an image.

6 The Client shall not copy or reproduce an image without the express consent of the Supplier.

7 The Client shall not give, sell, rent or hire an image in whole or in part, to any third party without the written consent of the Supplier.

8 All images are for use in the UK only.

9 The Client shall ensure that where possible every use of the image is accompanied by an acknowledgement in the following form 'Image (s) supplied by Atmosferik Photography (plus name of individual photographer where applicable)'

10 The Supplier makes no representations or warranties that it owns the copyright or trademark in any images. The Client shall at his/her own expense obtain from the copyright owner or owners written permission to include any part of an image.

11 Defamatory, humiliating or libelous uses of images and models appearing in images are specifically and emphatically prohibited.

12 The Client shall not use any image for any unlawful or pornographic purpose.

13 The Client undertakes fully to indemnify the Supplier at all times against all actions, proceedings, claims (including proper and reasonable legal and other fees) howsoever arising from " infringement of any intellectual property rights in any part of the world as a result of the supply of images to and/or use of the images by Clients " an action for defamation or other contravention of English law.

14 In the event of any claim being made against the Supplier to which this clause applies, the Supplier shall promptly notify the Client in writing of any alleged infringement or other claim of which it has notice; and allow the Client to conduct any negotiations or litigation and settle any claim and give it all reasonable assistance to do so.
